Use your Firewall
If you have a persistent spammer sending messages to your users, and their ISP won't act, firewall them. Use whois for TCP/IP addresses to identify all their TCP/IP space, and deny traffic to and from their network. Spam is just another form of network abuse - treat it that way.
You may wish to keep track of space you block, and why, in case it interferes with communication with others in that space in the future.
